Cop father-son duo false accused by woman for dowry harassment
This lady works for IT sector, which invariably means a kind of comfortable working conditions like AC office, 5-day a week work etc.
Her husband and father both work for police. And she expects her husband to be available to her all time to fulfill all her demands.
The main issue here is not dowry but the different working timings due to altogether different working profiles.
When thinking of taking divorce it would have occurred to her that being working herself she would get less or no money as maintenance; and, how can she leave the husband and father-in-law's black money behind when separating.
Pat comes the solution in form of dowry harassment complaint!!!

MUMBAI: A father-son duo, employed with the Mumbai police, has been booked in a dowry case along with four other family members. The complaint was filed by Shreya aka Ratnaprabha (26), who is married to Sachin Jadhav (29), a constable.
Sachin’s father Chandrakant (54) is an assistant sub-inspector at the JJ Marg police station. Shreya, in her complaint, has stated that her in-laws were demanding a dowry of Rs 5 lakh. One of her main grouse is that her husband didn’t return home early from work. A sessions court has granted anticipatory bail to all the six accused.
Sachin and Shreya tied the knot in February 2009. They lived with Sachin’s parents, Chandrakant and Sangeeta, at Byculla. Shreya used to work in the IT sector.
In her statement to the Agripada police, Shreya stated that her husband used to return home late from work. She has claimed that Sachin gave her evasive replies every time she asked him about his late arrival. This, Shreya has alleged, forced her to stay up late. She has also said that staying up late upset her routine and made it difficult for her to juggle her job with household chores.
“Shreya has told us that the Jadhavs were putting pressure on her to get her to get money from her parents so that they could buy a new house,’’ a police officer said. “She claims she was taunted and abused verbally. Sachin’s sister Jyoti and cousins—Neelam Vidhate and Anita Bankar— have also been accused of harassment,’’ said the officer. While Vidhate lives in Junnar, Bankar resides in Lonavla.
Sachin’s counsel, MA Khan, said the constable had to rush for emergency as well as bandobast duties at odd hours. “As a result, he had to spend a lot of time away from his family,” said Khan.
The court granted anticipatory bail to all the accused on the grounds that their custody wasn’t required. “The Jadhavs are willing to return all the valuables that Shreya had brought at the time of the marriage,’’ Khan said.
Meanwhile, Shreya has filed for maintenance in a court at Sangamner in Ahmednagar, her hometown. She is currently living with her parents in Vashi.

Dowry harassment case after 31 years of marriage
Woman claims to being tortured for dowry for past 31 years, and claims she had to take legal recourse because as the torture became unbearable.
What a strong woman indeed to bear tortures for 31 years - Govt should really contemplate awarding her some medals like "Shaurya Chakra", "Paramveer Chakra" !!
The idiotic husband and his family - what a slow pace of torture that it took 31 years for them to take the torture to the unbearable level !!
By the way, "brokers in uniform" i.e. the police did try preliminary rounds of extortion failing which they moved to FIR to extort legally.

Live-in partners splits, woman files false criminal case against partner
Just how easy is it for women to exploit and abuse the Indian laws and judicial process has become evident once more in yet another false case!!
This lady entered into a live-in relationship while studying in UK. Subsequently, she delivers a baby in 2009 in UK.
Next, with intentions to extort from the guy, she files complaints against him with charges of domestic violence and rape while in UK itself.
It is very much evident that these were false complaints as these were filed about the 1 year after the birth of their child. But unlike Indian processes, the UK processes are lesser blind, and she had to herself withdraw all the allegations by signing an affidavit.
After some more time the couple returns India and go their separate ways. Now, this woman how much this woman is empowered in INDIA owing to the "Kannoon andha hota hai" (Law is blind) philosophy, and realizing she can extort good amount using (abusing) the Indian judicial processes, she goes ahead and files false criminal cases of IPC 498a, not one but two cases!!!
She wants money, uninterrupted and unquestioned custody of the child which is already with her and on top of that maintenance as well!!

NEW DELHI: After throwing its weight behind live-in relationships saying there is no illegality if two adults live together, the Supreme Court is facing a difficult emotional fallout of it.
What if two adults decide to live together in a foreign country, share an apartment and have a child and when they come back, the man goes away saying he had no formal relationship with the woman and hence was not liable to her and the child's maintenance?
This question has cropped up before the Supreme Court, which has stayed proceedings initiated by a woman under Section 498A of Indian Penal Code in Gujarat. But realising the sensitivity of the issues involved, it posted the case for hearing on May 7.
The case is between Japmandeep and Rajshri. He went to London on a student visa in March 2003 to do post-graduation in information technology from London College of Management and IT. There he met Rajshri, who was pursuing her masters in IT since October 2002. According to Japmandeep, "they became friends and in October 2003 started sharing the same apartment".
"We shared an apartment in UK, but no religious ceremony for performing marriage took place in London nor did we register any civil partnership as is required under the law of UK. As per UK law, no relationship between the parties exist unless the formalities required under the law of UK are complied with," Japmandeep said in his petition before the SC seeking quashing of the proceedings initiated by his erstwhile live-in partner.
But there was not a word by the man that a child was born to them in 2005 in UK. After staying the proceedings, the SC issued notice to Rajshri, who in her response submitted documents, including the birth certificate of the child from UK.
The birth certificate showed that the child was born to Japmandeep Singh Ahluwalia and Rajshri Ahluwalia on November 9, 2005, at Wexham Park Hospital, Slough. A copy of the passport annexed to the reply filed in the SC through lawyer H A Raichura also gave identical description of the child's parents.
To falsify Rajshri's claim that she was married to him, Japmandeep stated in his petition filed through counsel J S Chhabra that she on October 10, 2006, had made a complaint about domestic violence and rape against him to UK authorities. "However, on December 8, 2006, the complainant withdrew all the allegations levelled against him and signed a statutory declaration in the form of an affidavit before the oath commissioner in England that all the allegations regarding domestic violence, rape and dowry were false and untrue," Japmandeep said.
But after they reached India on August 29, 2008, Rajshri left for her home in Gujarat and Japmandeep went to Patiala, where his parents lived. "All the communication which have taken place in the year 2008, between Rajshri and Department of Home Office, UK, she was addressed as Rajshri Ben Vijay Kumar Kesri and Japmandeep was addressed as her partner and not her husband," he said in his defence.
Rajshri initiated proceedings under Section 498A at Patiala and Ahmedabad, and both have been stayed by higher courts — one by Punjab and Haryana HC and the other by SC. However, Rajshri in her response to the apex court expressed willingness to compromise with Japmandeep allowing him to contract fresh marriage provided he returns the money, ornaments and certificates he owed to her, the 4-year-old son remains with her and pays a lumpsum amount to her for maintenance.

Criminal and Divorce suits filed by woman on FRIVOLOUS grounds of Saari
There are several such women who do not want to put any efforts in understanding the prospective in-laws before marriage, nor want to make any adjustments post-marriage.
And then post-marriage, they resort to dirty tricks of dragging all the in-laws into CRIMINAL cases, and label the husband as 'adulterous'.
Again, the typical behavior of judges where they do not take notice of the harassment meted out to the husband's family because of such frivolous case.
This INACTION of the judges is the single biggest reason why false and frivolous cases do not cease in India.
A very beautiful comment by someone on this news article:

Yet another Engineer Woman files false Dowry Harassment case against Husband
father's life.
Immediately after the wedding, Sarvamangala's in-laws allegedly began demanding that she bring Rs 50 lakh if she wanted to avert a break-up, though her family had made it clear before the wedding itself that it would not pay any dowry. Still, the family paid Gagan Rs 3 lakh (he had demanded Rs 5 lakh) and 250 gm of gold after their engagement.
Apparently, not happy, Gagan's family even telephoned the girl's parents demanding Rs 50 lakh.
On Aug 29 last, he even tried to choke and kill Sarvamangala with a pillow. When she pushed him hard while trying to resist, he sustained a fracture in the hand, says Sarvamangala's police complaint.

Woman implicates kids in criminal case
18 Jul 2007, 1546 hrs IST

Crime Abettor Woman Accuses 2 month old for harassment
It has become fashionable for wives in India to implicate their husband and in-laws at her whims and fancies for not doing or fulfilling her wishes.
And this case takes the misuse too far to implicate even a 2-months old.
Police are normally paid by wives or her parents to expedite the arrest. Apart from this money, police having intentions to extort more from the husband's family doesn't look for any evidence or motive of crime and simply comes knocking on the doors of the accused to arrest. Here they did not even care to find out how a 2-months old can possibly ever cause harassment of the nature defined in IPC 498a, but simply went ahead with the arrestation procedures!!!
Stepmom names two-month-old in dowry FIR

Mumbai: In diapers, lying in her mother's lap and yet to sprout teeth, but Zoya is an accused in a dowry harassment case. The two-month-old baby was named along with seven adults by her stepmother in a complaint letter to the police. What is worse is that the police has included the child's name in the FIR.
Zoya - who should be playing in crib - had to spend several hours in a police station with her mother, foregoing food and sleep and came very close to being arrested.
Her mother, Reshma Shamsuddin Khan, pleaded with the police. "Sahab ye toh choti bacchi hai. Iska aapne kaise complaint le liye. Toh woh bole nai kuch problem nahin hai, hota hai saat-aath saal ke bachi ka bhi hamare paas case hai. Tab humney socha ke court jayenge. (I told them that she is a baby and how can you write her name in the FIR. The policemen said that it was no big deal and that they had other cases against young children too. That's when we decided to go to court.")
Not surprisingly, Zoya is the youngest bail applicant before the Mumbai Sessions Court. She was granted anticipatory bail on Sunday and is now safely in her mother's care.
The defense lawyer, Ashok Bhole said, "My client called me and told me everything. I saw that the child's name was also in the complaint, so I quickly filed a bail application in the sessions court."
Meanwhile, legal experts are stunned to say the least.
Advocate Usha Makasare says, "It is crazy. Unheard of. We will have to see under what circumstances the court has given this order."
In all this, one wonders what prompted the complainant to drag the child into the mess and worse still, was it right for the police to have even called the child to the police station? The officer who is to blame for this bizarre incident has now been suspended and the child's name removed from the FIR.

Crime abettor woman got Punishment
http://navabharat.org/images/040510raj7news2.jpg
How many times in India have you seen that a woman and her parents/family who harass a husband and his family, such hard that the poor husband is driven to commit suicide?
The story in this news article picture is about one such RAREST-of-RARE cases where a woman and her father have been awarded a 5 years' rigorous imprisonment.
It's important here to note that this husband was no less than a man working in the Police department of India. Any Indian would tell you without even a blink how much a common man is afraid of Police because of various reasons.
But here was this man, a constable with Police department in Raipur (Chhattisgarh, India), who was helpless in front of his own wife.
WHY??
Police is famous as a department in India where laws are bend/violated/ignored in every possible way. Still this poor constable could not help him?
A man, associated with a department meant (it's other matter though that this meaning doesn't hold anymore) to help and save common man, was himself so helpless that he found no other way but to commit suicide !!
WHY??
Did he not take help from his seniors in Police department itself? Could his seniors have helped him save his life, but could not do so?
WHY??
The reason is the LAW-making factory in India which works under the influence of Ministry of Women and Child Development (WCD) and the National Commission for Women (NCW) and churns out seriously flawed gender-biased laws which only help the "Wife"(s) of India. Although, these govt organs are supposed to work for all the women (like mothers , sisters, aunts etc.), the reality is that these prefer to work against MEN. Many laws like IPC 498A, Domestic Violence Act (DV) etc. have been the handiwork of these organs. Misuse of these laws have unleashed unprecedented hardships not only for the husbands, but also for his mother, father, sister, brother-in-law, aunt etc... i.e. whole family and is breaking the family fabric of India.
What happened with this police constable, Arun, is not anything new or unusual. Similar stories like his are today happening all over India. The provisions in these laws are so biased that husband and his entire family gets labeled as criminals as soon as any complaint is filed against them. And, there is no provision to punish unscrupulous women who misuse these laws for their personal financial gains or for taking revenge on petty issues.
As a result of misuse of these laws lakhs of innocent people including Men, Women, Old-age, minors have been put behind bars over past several years. Have a look at the statistics here: http://stats.498a.org/
According to National Crime Records Bureau, around 58000 married men committed suicide.
Have a look at the expose by The Sunday Indian on IPC498A misuse here : How and why the law is an Ass
How much welcome is this Judgement?
This judgement should be lauded for the reason that it's a first time such a decision has been delivered where a wife and her father were labeled as criminals, declared guilty and awarded punishment.
I would, however, take this judgement with a pinch of salt.
A bigger picture of the role of women-favoring laws has again been missed. A review of these laws could have been ordered by the judge.
There is no talk on the role of this constable's seniors. They should have been the first ones to protect his life.
Until the system is rectified, husbands and their families will keep getting harassed like this. Many like Arun are dying unnatural deaths by committing suicides every year.
