A 25-year-old ‘rape victim’ stunned the court on Thursday when she appeared for the hearing of her alleged attacker, and claimed that she had concocted the entire story to save her marriage.

On Wednesday evening, the woman was at her home in Tisgaon, Kalyan (E) - in bed with her lover of 11 months, Dr Ramesh Ghavri - when her husband walked in on them. Dr Ghavri left immediately, and - in a bid to pacify her husband - the woman cried rape.

Later that night, the couple approached the Koslewadi Police Station in Kalyan (E), and the woman was sent for a medical examination. By 11.15 pm, the report was in, and the woman registered a case of rape against Dr Ghavri.

Around 4 am, police were able to locate Dr Ghavri in Dombivli and arrested him. He was charged under Section 376 (rape) of the Indian Penal Code.

On Thursday afternoon, as Dr Ghavri was being produced before First Class Judicial Magistrate T B Lokhande of Kalyan court for police custody, the woman made a dramatic entry and told the court Dr Ghavri had not raped her. She stated the accused was in fact her lover and pleaded with the court to set him free.

“The court has now directed us to further investigate the matter and file a report,” said Sub-Inspector A B Pathan. He added that primary investigations have revealed that the lovers were caught red-handed by her husband. “She filed a case of rape in order to save her marriage,” said Pathan.

He explained that as per the law, they have initiated a fresh investigation so that the accused doctor could be discharged from the case. The woman will now face charges of filing a false complaint. However, misleading the police is a non-cognisable offence, which does not invite severe punishment.

“We are discussing the case with our superiors to find out how to handle it. This is the first time such a case has come up before us,” said Pathan.

Meanwhile, Dr Ghavri has been sent to judicial custody. His advocate, A Y Patki, said of the woman, “She displayed lot of courage by appearing in person before the court on her own accord and making a statement. She told the court that she and Dr Ghavri were having an affair for the last one year and that they had sex out of mutual consent.”

Patki added that the matter would be heard on Friday and depending on the report filed by the police, the court would decide on it. “With the woman’s statement, the case of rape does not stand,” he concluded.

Several attempts to speak to the woman did not yield any results, as she refused to comment.
